Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the DeadQueue platform and related websites, products, and services (collectively, the "Service") offered by Venerite Enterprises, LLC ("Venerite", "we", "our", "us"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and ourPrivacy Policy. If you do not agree, do not use the Service.
2. Eligibility & Account Registration
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
3. Description of Service
DeadQueue provides monitoring, alerting, and management tools for AWS SQS dead letter queues. The Service polls your AWS queues via read-only API access, tracks queue depth and message age, delivers alerts, and facilitates message replay. We may enhance or modify the Service at any time without prior notice. Certain features may be in beta and offered "as is."
4. User Responsibilities
- Ensure that information you provide is accurate, complete, and kept up to date.
- Maintain appropriate IAM policies and access controls for your AWS accounts; you are solely responsible for the security of your AWS credentials and configurations.
- Do not use the Service to monitor queues or accounts you are not authorized to access.
- Comply with all applicable laws, regulations, and industry standards, including the AWS Acceptable Use Policy.
5. AWS Credentials & Access
You retain all ownership and control of your AWS accounts. DeadQueue accesses your AWS resources using read-only IAM roles or access keys that you provision. IAM access keys are encrypted at rest using AES-256. You are solely responsible for the scope of permissions granted and for revoking access at any time. Venerite is not responsible for losses arising from misconfigured IAM policies or unauthorized access to your AWS accounts.
6. Fees & Payment
Access to certain features requires payment of subscription fees described on the Service. Fees are billed in advance and are non-refundable except as required by law. You authorize us to charge your chosen payment method on a recurring basis until you cancel. Failure to pay may result in suspension or termination.
7. Intellectual Property
The Service, including all software, trademarks, and content, is owned by Venerite or its licensors and protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service.
8. Confidentiality
Both parties agree to keep confidential information disclosed in connection with the Service in strict confidence and to use it solely for the purposes of these Terms, unless required by law.
9. Termination
We may suspend or terminate your access to the Service at any time for any reason, including a breach of these Terms. Upon termination, your right to use the Service will immediately cease, and we may delete your data in accordance with our data-retention policy.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT GUARANTEE THAT ALERTS WILL BE DELIVERED WITHOUT DELAY OR THAT ALL QUEUE ISSUES WILL BE DETECTED.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VENERITE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, EVEN IF ADVISED OF THE POSSIBILITY. THIS INCLUDES ANY LOSSES ARISING FROM MISSED ALERTS, EXPIRED MESSAGES, OR MESSAGE REPLAY OPERATIONS.
12. Indemnification
You agree to indemnify and hold harmless Venerite, its directors, employees, and agents from any claims, liabilities, or expenses arising out of your use of the Service or violation of these Terms.
13. Changes to Terms
We may revise these Terms at any time. We will notify you of material changes by posting the updated Terms in the Service or sending an email to the address on file. Continued use constitutes acceptance of the revised Terms.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Idaho, U.S.A., without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Boise, Idaho, and you consent to the personal jurisdiction of those courts.
